// Terms of service
Terms of service.
These terms are the agreement between you and Swiftnex Tech (Pty) Ltd for using Albert: the desktop app, your Albert account, and the website. By creating an account or using Albert, you agree to them.
Effective 19 October 2026.
Who you are dealing with
- Supplier: Swiftnex Tech (Pty) Ltd, a private company registered in South Africa, trading as SwiftNextech.
- Registration number: 2023/264956/07 (Companies and Intellectual Property Commission).
- Registered and physical address (also for legal notices): 1021 Draaibos Ave, Weltevredenpark Ext 45, Johannesburg, Gauteng, 1709, South Africa.
- Email: [email protected] · Phone: +27 67 586 9544 · Website: albertai.tech
1. The service
- Albert is a desktop app for Mac and Windows that runs software projects: meeting notes, plans, designs, builds with Claude Code, a team board, client pages, collaboration between assistants, and demo videos.
- Albert needs an Albert account to work. Some features also use accounts you hold elsewhere, such as Claude, GitHub, Google or Telegram; those are covered by their own terms.
- We keep improving Albert. Features may change, and we may add, change or retire features. We will not take away something you have paid for in the current month without a refund for that part.
2. Your account
- You must be 18 or older, or have the permission of a parent or guardian, and able to enter into a binding agreement.
- Give accurate details and keep your sign-in safe. You are responsible for what happens under your account; tell us straight away at [email protected] if you think someone else has used it.
- If you use Albert for a business, you confirm you may accept these terms for it.
3. Plans, prices and payment
- Free plan: free of charge, within the limits shown on the pricing page.
- Paid plans (Starter, Individual, Team) and the cloud computer add-on are monthly subscriptions. Prices are shown on the pricing page in South African rand (ZAR), the currency you are charged in.
- Payment is taken by card through Paystack, in South African rand (ZAR), monthly in advance on the same date each month until you cancel. If your card is in another currency, your bank converts the amount at its own rate and may add a fee; that is outside our control. We never see or store your full card number.
- Team subscriptions are priced per member, with a minimum of two members including the owner.
- Cloud computer: the first 7 days are free and need a card. Unless you cancel during those 7 days, the monthly charge starts when they end.
- AI usage: each plan includes a monthly amount of AI usage for the models Albert uses, which you can track in the app. Plans are limited by this usage, not by a count of designs or builds. Your plan's usage resets each month.
- Top-ups: subscribers can buy extra AI usage. A top-up does not reset: what is left carries over to the next month, and your plan's usage is used first. A top-up works only while you have a paid plan; if your plan ends, what is left is paused, not lost, and comes back when you subscribe again. Paid top-up lasts 3 years from purchase. Subscribers get a 10% bonus on each top-up; the bonus is free and lasts 3 months.
- Price changes: we will tell you by email at least 30 days before a price change applies to your subscription. You can cancel before it takes effect.
- Prices include any tax we are required to charge.
4. Cancelling and refunds
You can cancel at any time. Cancellation, the 7-day cooling-off period and refunds are explained in our Refund & cancellation policy, which forms part of these terms.
5. Your content and what Albert makes
- Your content stays yours: your projects, files, meeting notes, plans, designs and code. You give us only the permission we need to store, process and show it to you and to the people you choose to share it with, so that Albert works.
- What Albert makes for you is yours (plans, designs, code, videos), subject to the rights of others in anything you put in.
- Check AI output before you rely on it. Albert uses AI models, which can be wrong. Review plans, designs, code and answers before you use them, ship them or send them to anyone.
- Builds run in your own repository on your own computer and accounts, always on a branch; you decide what to merge.
- How we handle personal information is set out in our Privacy policy and Where your data goes.
6. Acceptable use
- Do not use Albert to break the law, to infringe anyone's rights, or to harm, harass or deceive people.
- Get the consent the law requires before recording or transcribing a meeting, and tell the people in a call that Albert is there.
- Do not try to break, overload, reverse-engineer or get around the limits or security of Albert or its services, or resell access without our written agreement.
- We may suspend or close an account that breaks these rules. Where reasonable, we will warn you first and give you a chance to fix it.
7. Other companies' services
Albert works with services from other companies, such as AI model providers, Google Meet, Microsoft Teams, Zoom, GitHub, Claude Code and Paystack. Their availability and terms are outside our control, and a change on their side may affect a feature.
Albert is made by Swiftnex Tech. It is not made or endorsed by Anthropic, and we are not an Anthropic partner. Claude and Claude Code are Anthropic's trademarks. Albert runs Claude Code on your own Claude account, which you sign in to yourself; we never share one Claude account between people. Read how Albert uses Claude.
8. Availability and liability
- We work to keep Albert available and working, but we cannot promise it will never be interrupted or free of faults.
- As far as the law allows, we are not liable for indirect or consequential loss, such as lost profit, lost data or lost business, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.
- Nothing in these terms limits rights you have under the Consumer Protection Act, the Electronic Communications and Transactions Act, or any other law that cannot be limited by agreement.
9. Ending the agreement
- You can stop using Albert and cancel any subscription at any time.
- We may end the service to you for a serious or repeated breach of these terms, or if the law requires it. If we end it for any other reason, we will give you at least 30 days' notice and refund any payment for time you have not used.
- Before an account is closed, you can export your work.
10. Changes to these terms
We may update these terms. For a change that matters, we will email you at least 30 days before it applies. If you do not agree, you can cancel before then. The date at the top shows when these terms last changed.
11. Law and disputes
These terms are governed by the law of the Republic of South Africa. If something goes wrong, please contact us first at [email protected] and we will try to resolve it. Formal notices can be sent to our registered address above.
